5. Assumption of Risk, Release, and Limitation of Liability
You acknowledge the risks associated with endurance sports, physical activities, or business decisions informed by our Services. You voluntarily assume all such risks and hereby release, waive, discharge, and covenant not to sue 5280 Endurance, its owners, consultants, employees, affiliates, and representatives from any and all liability, claims, demands, damages, or causes of action (known or unknown) arising from or related to your use of the Services, reliance on our advice, or any related activities.
To the fullest extent permitted by Colorado law, we disclaim liability for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, opportunities, or goodwill, whether in contract, tort (including negligence), strict liability, or otherwise.
Our total liability for any claim shall not exceed the amount you paid us for the specific Services giving rise to the claim in the twelve (12) months preceding it (or $100 if no payment was made). This limitation applies even if advised of the possibility of such damages.
Note: Colorado law does not permit waivers of liability for gross negligence, willful or wanton conduct, reckless disregard, or intentional acts. Nothing herein limits liability for such conduct where prohibited by law.
